These Terms & Conditions (“Terms”) govern all training, coaching, consulting, and learning services provided by Fordax Training Academy or Fordax Business School (“Fordax”, “we”, “our”, “us”).
By enrolling in any Fordax program, the participant (“Client”, “you”, “your”) acknowledges, understands, and agrees to these Terms.
If/when Fordax signs a separate written agreement with you or your organization, that agreement overrides any conflicting provision in these Terms.
1. Registration & Payment
1.1. A participant is officially registered only after full payment is made or a mutually accepted payment plan is agreed upon.
1.2. All payments confirm seat reservation, resource allocation, and administrative processing.
1.3. Fordax reserves the right to refuse service if payment obligations are not met.
2. General Refund Policy
2.1. Once payment is received, we begin committing resources to your enrollment, including facilitators, materials, scheduling, and administrative processes. These costs make refunds difficult except in the specific cases outlined in these Terms.
2.2. Advance Payment Clause
Fordax allows clients to make advance payments for upcoming programs, courses, or events.
Advance payments may be refunded only if the client meets the same refund conditions and procedures outlined in Sections 2.2 and 2.3 of these Terms. All advance payments follow the same rules governing cancellations, deferrals, administrative deductions, and eligibility for refunds.
2.2. Non-Refund Clause for Deferrals, Cancellations, and Change of Mind
Fordax does not issue refunds when a student defers, cancels, or changes their mind after making payment for any program.
However, the student’s fees may be:
- Transferred to another cohort
- Moved to a different program
- Reserved for future use
- The ticket or payment can be transferred to someone else.
This is strictly at the discretion of Fordax management. All approved transfers or future-use credits must be utilized within six (6) months from the original date of payment. After this period, all credit automatically expires and becomes non-refundable and non-transferable.
2.3. Refunds are only provided under the specific conditions listed in Sections 3 and 4.
3. Refunds Under Limited and Exceptional Circumstances
Fordax may consider a full or partial refund under the following rare, verifiable, and exceptional situations:
- Documented medical emergencies affecting the participant
- Severe personal or family emergencies approved at management’s discretion
- Other extraordinary conditions approved at management’s discretion
3.1. Supporting documents may be required.
3.2. Approval is not automatic and is reviewed case-by-case.
3.3. Approved refunds may attract administrative deductions of 10%–30%, at the discretion of the management.
4. Refunds When Fordax Is Responsible
4.1. Fordax will issue a 100% refund if:
- We cancel a program and do not offer an acceptable alternative
- We fail to deliver the training and rescheduling is not possible
4.2. Refunds will be processed within the timeline communicated by the administration, typically within 25 business days.
5. No-Show, Attendance Policy & Rescheduling
5.1. If a participant fails to attend a session or program without written notice approved by management, all fees are forfeited.
5.2. Missed sessions are considered used and will not attract refunds.
5.3. Fordax expects all students to complete their program within the scheduled period.
However, a student may request a re-schedule or postponement by submitting a written request at least 7 days before the program begins. Requests made after this period are not guaranteed and will only be approved at the discretion of Fordax.
Rescheduling, postponing, or deferring may be rescheduled into any future available class or alternative learning methods (including virtual, blended, scripted and other possible options) as determined by Fordax.
6. Cancellation & Deferral by the Client
6.1. Clients who cancel at least 7 days before the start date and notify us in writing may receive a full refund or deferral.
6.2. Cancellations or deferrals requested less than 7 days before the start date are non-refundable.
6.3. Deferrals requested after the program begins are not allowed, except at Fordax’s discretion.
7. Transfers, Replacement Participants & Discretionary Adjustments
7.1. Clients may request a transfer of their fees to a future class or alternative program.
7.2. Transfers are granted at Fordax’s discretion based on:
- Availability
- Justification for the request
- Administrative impact
- Program structure
- Supporting documentation
7.3. Transfers may attract administrative fees.
7.4. A participant may nominate a replacement attendee, subject to Fordax’s approval.
8. Program Delivery & Quality Assurance
8.1. Fordax is committed to delivering high-quality training.
8.2. If a facilitator cannot attend due to an emergency, Fordax may:
- Assign another qualified facilitator
- Reschedule the class
- Provide an alternative delivery format
8.3. All training materials remain the intellectual property of Fordax and may not be copied, shared, distributed, or reproduced without written permission.
9. Force Majeure
Fordax shall not be liable for delays, rescheduling, or cancellations caused by events beyond our control, including:
- Natural disasters or fire
- Government regulations
- Public health crises
- Strikes, riots, protests
- Civil unrest or national emergencies
- Infrastructure or operational disruptions
Fordax will provide alternatives such as rescheduling, virtual classes, or transfers. Refunds may not apply except as described in Sections 3 and 4.
10. Certificates, Completion Requirements & Rights
10.1. Certificates are issued only when participants meet attendance, participation, and performance requirements.
10.2. Fordax reserves the right to withhold or withdraw certificates if:
- Fraudulent information is provided
- Misconduct occurs
- Payment obligations are incomplete
- Program requirements are not fulfilled
10.3. Certificate withdrawal is rare and used only for serious violations.
11. Code of Conduct and Termination Policy
Participants are expected to maintain respectful and professional behavior toward staff, fellow participants, and the facility environment. Fordax strictly prohibits any form of discrimination, including on the basis of gender, religion, ethnicity, or personal beliefs.
Fordax reserves the right to immediately cancel the admission or registration and remove any participant who disrupts the class, violates ethical standards, compromises safety, or breaches the established Code of Conduct.
In the event that a participant’s admission or registration is canceled on any of the grounds discussed above, Fordax will not offer a refund of any fees paid.
12. No Verbal Agreement Clause
All agreements, promises, or assurances relating to Fordax programs must be in writing and officially issued by Fordax.
Verbal statements made by staff, facilitators, or representatives are not binding. Only written communication—email, letter, invoice, or signed document—serves as valid proof of agreement.
13. Dispute Resolution Clause
In case of any dispute arising from participation in a Fordax program, both parties agree to pursue mediation or arbitration before litigation.
Mediation or arbitration shall be conducted in Nigeria.
Litigation may only be considered after all alternative dispute-resolution steps have been exhausted.
14. Privacy & Data Protection Clause
Fordax is committed to protecting client information. Personal data collected—including names, contacts, images, and other details—will be used solely for:
- Administrative purposes
- Communication
- Training operations
- Record-keeping
Fordax will never sell or share data with third parties except when required by law or essential for operations. Clients may request correction or deletion of their personal data by contacting Fordax in writing. By enrolling, clients consent to the collection and use of their data under these conditions.
15. Use of Images, Video, Audio & Media
A. During Fordax programs, training sessions, and events, the Fordax team may capture photos, videos, audio, or other media for documentation, educational use, publicity, and promotional purposes. By enrolling in a group program, clients grant Fordax the right to capture, use, store, and publish such media without further permission or compensation. All captured media remains Fordax property.
B. Clients who do not wish to appear in media must notify Fordax in writing before the program begins. Individual photos or videos may be removed upon request, provided they do not feature other participants. Group photos and recordings cannot be altered or removed.
16. Personal Property Responsibility Clause
Students are solely responsible for the safety and security of all personal property, including but not limited to vehicles, car keys, mobile phones, wallets, computers, and bags, while attending Fordax events.
Students are advised to keep their items secure and with them at all times. Fordax will not be held responsible for the loss, theft, or damage of any personal property. All Fordax staff are expressly waived from any and all liability related to the security and protection of student property.
17. Private Engagements with Fordax Affiliates and Associated Individuals
Fordax provides all official services and agreements exclusively through corporate channels.
Fordax expressly disclaims all responsibility and liability for any private business, service arrangements, or financial transactions entered into between a client and any Fordax affiliate, including individual staff members, partners, students, alumni, or members, when conducted on a personal basis.
This includes, but is not limited to: private coaching, consulting, personal services, or any arrangement where the contract or payment was not officially executed and directed to the official bank details of Fordax.
Clients who choose to engage in such private dealings do so entirely at their own risk. Fordax is expressly waived from all accountability for service quality, fulfillment of obligations, financial disputes, or any resulting damages from these non-Fordax endorsed arrangements.
18. Update & Modification of Terms Clause
Fordax reserves the right to update, modify, or revise these Terms & Conditions at any time as necessary to reflect changes in our policies, services, operations, or legal requirements. All updates will take effect immediately upon publication on our official website or through any other official communication channel. Continued participation in any Fordax program after such updates constitute acceptance of the revised Terms.
19. Acceptance of Terms
By registering, paying, or attending any Fordax program, the client confirms that they have read, understood, and agreed to these Terms & Conditions.
